90a. Restoring Benefits After an IPV
Unless the IPV disqualification is for life, counties must restore benefits to IPV-sanctioned household members when their period of administrative disqualification has ended. The Notice of Administrative Disqualification must be accompanied by a Request For Restoration Of CalFresh Benefits After Administrative Disqualification form. If the disqualified household member is still a member of the CalFresh household in which he or she was previously receiving benefits, the county will automatically add the person back into the household the month following the expiration of the disqualification period. If the county is missing verification regarding this person, the county must provide written notice and allow at least ten (10) days for the verification to be returned. The individual fails to provide this verification, the county must issue a Notice denying aid for this person, based on failure to verify.
If the disqualified household member is now a member of a different CalFresh household, and this has been reported to the County, the County must automatically add the individual to the CalFresh household the month following the end of the disqualification period.
If the disqualified household member is now a member of a different CalFresh household, and the change in household has not been reported to the CWD, the disqualified household member must ask to be added to the new household. The County would then add this person back in, if otherwise eligible, the month following the end of the disqualification period. (So, the request should be made at least 30 days prior to the end of the disqualification period to avoid a loss in benefits). If the formerly disqualified person is the only member of the CalFresh unit, s/he must reapply. (This can be done in advance of the end of the penalty to avoid a loss in benefits.)
